Terms of Sales
1. Object
Beni.fr (hereinafter referred to as “the Website”) is published and operated by the company Slow Life Company SAS (hereinafter referred to as “SLC”), having its head office at 2 rue Huysmans – 75006 Paris, with registered capital of €1,000, registered in the Paris Companies Register under number 829 483 288, and whose intra-community VAT number is the following: FR42829483288.
2. Scope of application and acceptance of the general conditions of sale
The general conditions of sale (the “CGV”) detailed below apply to all orders for products and services placed via the Website with the company SLC for all items and services offered on the beni site. The Products are all the goods offered for sale by SLC on the Website within the limits of available stocks.
SLC incurs no liability in the event of stock shortage or unavailability of Products for orders not yet accepted by SLC. Errors or modifications may exceptionally exist, particularly in the case of simultaneous orders for the same Product by several Customers. In the event that a Product is unavailable after placing your order, we will inform you by email or telephone as soon as possible, offering you either to order another Product presented on the Website as a replacement, or to cancel and refund your order.
SLC ensures the correct presentation and description of its Products to best satisfy the Customer's information. However, it is possible that errors may appear on the Site, which the Customer acknowledges and accepts. SLC does not guarantee the accuracy or security of any information transmitted or obtained through the Site.
It is possible that the Customer may receive a part previously returned by another person following an Order. It is specified that SLC only accepts the return of intact and unworn Products, these two conditions being verified before returning the returned Products to stock.
4. Orders
Customers can order on the Website at www.beni.fr. Taking an order on the Website is subject to compliance with the procedure set up by SLC materialized by a succession of steps that the Customer must follow leading to the validation of their Order. Validation of the Order constitutes confirmation of the Customer's acceptance of the General Terms and Conditions, the Products purchased, their price as well as the associated costs. A confirmation of the order validated by the Customer will be sent to him by email prior to dispatch of the order, and will make the sale final subject to the right to exercise the right of withdrawal. To this end, the Customer formally accepts the use of email for confirmation by SLC of the content of his Order. When placing the order, the Customer must ensure the accuracy and completeness of the data he provides. In the event of an error in the wording of the recipient's contact details, SLC cannot be held responsible for the impossibility of delivering Products.
5. Price and payment terms
SLC reserves the right to modify the prices of the Products offered on the Website at any time and without notice. The Products are invoiced on the basis of the prices displayed on the Website at the time the order is placed, subject to availability of the Products ordered at that time.
All prices displayed are calculated including value added tax (VAT) applicable in France, which may be different depending on the invoicing country.
The prices of the Products are indicated in euros, all taxes included, excluding shipping costs. The total price of the order (including all taxes and shipping costs) is indicated in the basket. Customs clearance, payment of various duties or taxes are the responsibility of the Customer.
The products are payable in cash at the time of the actual Order. The products remain the property of SLC until full payment of the price.
The following payment methods are accepted: credit cards and bank cards (Visa®, MasterCard®, American Express®) via the secure platform implemented by Stripe (https://stripe.com/fr) and PayPal. The Customer expressly acknowledges that the communication of his bank card number to SLC constitutes authorization to debit his Account up to the price of the Products ordered.
The data recorded and kept by SLC constitutes proof of the Order and all past sales. The data recorded by Paypal or Stripe constitutes proof of any financial transaction between the Customer and SLC.
6. Delivery terms
Delivery times indicated are in working days. Deliveries are ensured by the services of Poste Colissimo, Chronopost, or TNT, from Monday to Saturday, depending on the option chosen by the Customer when validating their order.
The Delivery costs applicable to the Order are those mentioned on the Site at the time of the Order.
The Products are shipped to the Delivery address indicated by the Customer, it being specified that this must be the residence address of the Customer, of a natural person of his choice or of a legal entity (delivery to his company ). SLC will not process any order for which a poste poste, hotel, PO box or Cedex address is provided. SLC cannot be held responsible in the event of an incorrect or incomplete address indicated by the Customer.
Deliveries can also be made to a Relay Point by the TNT service provider, subject to acceptance of the package by the selected Relay Point.
If it is impossible to carry out the Delivery, SLC endeavors to find a secure place to deposit the Product. Failing this, the Product is returned to the SLC warehouse upon receipt of the Product.
In the event that the Customer's order concerns several Products, SLC reserves the right to send them in several installments. The charge to your credit or payment card will be split in the same way to correspond to the price of the Products actually delivered. Transport costs will only be invoiced for a single shipment and in accordance with the indications in your order summary.
For any order placed on the Website, SLC undertakes to prepare the Customers' order within 48 to 72 working hours (excluding weekends and public holidays) and a maximum of twelve (12) working days for Delivery in France Metropolitan and twenty (20) working days for international delivery during periods of high activity (Christmas, sales, etc.), it being specified that these deadlines only run from the validation of your order by our Customer Service.
The Customer must ensure that they have communicated accurate and complete information concerning the Delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or telephone numbers). intercom, etc.).
The deadlines indicated are indicative deadlines, corresponding to the average processing and delivery times. SLC cannot be held responsible for the consequences due to a delivery delay not of its own making or justified by a case of force majeure (as defined below).
Any defect or delay in Delivery, longer than the Delivery times mentioned in Article 6, must be reported to our Customer Service as soon as possible by sending us an email to bonjour@beni.fr. Any complaint made beyond fourteen (14) calendar days after the date of validation of your order cannot be taken into account.
In the event of damage to the product, the customer must

7. Refunds and returns
The Customer has a legal right of withdrawal which he can exercise under the conditions provided for by articles L. 121-21, L. 121-21-1 and L. 121-21-2 of the Consumer Code in a period of 30 days following receipt of the order, if the Customer meets the conditions set out in these provisions, without having to justify reasons and without having to pay penalties. Beyond this period of 30 (thirty) days, the sale is firm and final.

Returns must be made in their original condition and complete (packaging, accessories) in new condition, and accompanied by a copy of the purchase invoice. Upon receipt of the package, Béni will judge the perfect condition of the returned merchandise. No returns will be accepted if the returned items have been visibly used or damaged by the customer and this use or damage renders the items unfit for sale. If the return is refused, the items will then be returned to the customer. Return costs will be the responsibility of the customer.
Any reservations about the condition of the products (e.g. open or damaged package) must be notified immediately upon delivery.
In the event of a refund request, this will take place within a maximum period of fifteen (15) days from receipt of the Product(s) by SLC. Once the Products have been received, checked and accepted by us, the reimbursement, including the standard delivery costs of the initial order, will be made using the same payment method used when ordering. Please note, however, that an additional period may be applied by your bank during reimbursement.
The return of Products is free if the place of Delivery is in Metropolitan France. The return of the Products is the responsibility of the Customer if the place of Delivery is outside mainland France and is done at his own risk. The Customer must send an email to bonjour@beni.fr indicating the reasons why he wishes to make a return. The Customer will receive within a maximum of one week by email a return voucher to return their order as well as a transport voucher at the expense of SLC in the event of a delivery location in Metropolitan France, which it will be your responsibility to print .
In all cases, return costs are the responsibility of SLC if the Product delivered to the Customer is different from the Product ordered or if it is delivered damaged.
8. Legal guarantees
SLC has, for all stages of access to the site, from the ordering process to the shipment of the package or subsequent services, only an obligation of means. SLC cannot be held liable for any inconveniences or damages inherent in the use of the internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with the law and jurisprudence. In this regard, the Customer acknowledges that it is its responsibility to install appropriate anti-virus and security software on its computer hardware and any other device in order to protect them against any bugs, viruses or other programming routines. this order proving harmful.

SLC takes the greatest care in the presentation and description of its Products to best satisfy the Customer's information. SLC may replace the non-compliant Product. If replacement is impossible within one (1) month following the complaint or, if the Customer makes a duly justified request, he may request reimbursement of the price of the Product.
SLC will provide the Customer with a Product free from hidden defects which would make it unfit for the use for which it is intended, or which reduce this use to such an extent that the Customer would not have acquired it, or would have only given a lesser one. prices, if he had known them. This guarantee will only apply on the condition that the Customer makes the request within two (2) years from the discovery of the defect.

Force Majeure
In the event of the occurrence of a force majeure event preventing the execution of these General Terms and Conditions, SLC informs the Customer within fifteen (15) days of the occurrence of this event, by email or by registered letter with acknowledgment of receipt. Expressly, are considered as cases of force majeure or fortuitous event, in addition to those usually retained by the jurisprudence of French courts and tribunals, total or partial strikes, lock-outs, riots, boycotts or other actions of an industrial nature or disputes commercial activities, civil unrest, insurrection, war, bad weather, epidemic, blockage of means of transport or supply for any reason, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal changes or regulatory forms of marketing, computer failure, blocking of telecommunications, including wired or wireless telecommunications networks, and any other case beyond the control of the parties preventing the normal execution of the contractual relationship. All obligations of the parties are suspended for the duration of the force majeure event, without compensation. If the force majeure event continues for more than three (3) months, the transaction concerned may be terminated at the request of SLC or the Client without compensation to either party. Failure to pay by the Customer cannot be justified by a case of force majeure.
9. Partial Disability and Non-Waiver
If one or more stipulations of these General Terms and Conditions are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force. and their scope.
No tolerance, inaction or inertia on the part of SLC may be interpreted as a waiver of its rights to the terms
11. Applicable law – Disputes
The contract formed by acceptance of these General Terms and Conditions is subject to French law.
The language of this contract is French.
In the event of a dispute, the French courts will have sole jurisdiction.
In the event of a dispute, the Client and SLC may resort to conventional mediation. In this regard, SLC informs the Client of the existence of alternative methods of dispute resolution, such as mediation or arbitration.
In the event of discrepancies between the French version and the English version of the General Conditions of Sale, the French version will prevail.
